The Migration Expo is an enterprise of the Business Expo Pty Ltd. Any reference to the Migration Expo in this document or on the website is to be construed as also referring to The Business Expo Pty Ltd.

Acceptance and Amendments:
Users of this Website agree to be bound by these terms and conditions, which are subject to change at the sole discretion of The Migration Expo. Please remember to read these terms and conditions on a regular basis so that you are aware of any changes that we may make. Your use of and access to this site indicate your acceptance of these terms and conditions (or any changes to them).We may, from time to time and without notice, change or add to the Website or the information, products or services described in it.
However, we do not undertake to keep the Website updated. We are not liable to you or anyone else if errors occur in the information on the Website or if that information is not up-to-date.


Prohibited Practices and Membership Restriction
Users of the website may be subject to disqualification as subscribers, advertisers, members, or any other form of site access if they are deemed to be in breach of any of the following:
a)  Abuse of the website server, advertising system, networking functionality, migrant list, expo messaging systems
b)  Irresponsible data collection and use
c)  Misrepresentation of self, business, product or service

Any such disqualification or restrictions of access is wholly within the discretion of The Migration Expo, and no correspondence will be entered into.


Intellectual Property:
All intellectual property in relation to material included on this Website belongs to The Migration Expo or its licensors or advertisers, and Users obtain no interest in that property. All material on this Website is protected by Australian and international copyright and other intellectual property laws. Users may not do anything which interferes with or breaches those laws or the intellectual property rights in the material.


Use:
Users may download and view the material or print a copy of material on this Website for personal, non-commercial use provided you do not modify the copy from how it appears on this Website (including any copyright notice). All rights not expressly granted under these terms of use are reserved. Users will not use this Website for any purpose or in any way which is unlawful.


Third party content:
This Website may include third party content which is also subject to that third party's terms and conditions of use. This includes ‘Exhibitor Stand’ and ‘Presentation’ content, Advertisements (banner and within content). This document overrides any such third party terms and conditions, without exception.
Content is subject to general editorial review before acceptance.  The Migration Expo will make its best efforts to check all such submitted material and will, at its earliest opportunity, remove/delete any content seen to be in breach of any sections of this document referring to prohibited content or practices. The Migration Expo will not be held liable for any such content which has escaped notice for whatever reason (including through negligence) but will, at its earliest opportunity, remove/delete any content seen to be in breach of any sections of this document referring to prohibited content or practices.


Third party links:
This Website may include links to third party sites which are not related to The Migration Expo and in relation to which The Migration Expo has no control or interest. The appearance of those links on this Website does not indicate any relationship between The Migration Expo and that third party or any endorsement by The Migration Expo of that third party, its site or the products or services which it is advertising on this Website.


Promotions:
Terms and conditions of entry for any promotions or competitions on the Website will appear with that competition/promotion and you should read those in conjunction with these terms and conditions.


No Liability:
The Migration Expo will have no responsibility or liability in relation to any loss or damage (whether it be direct or indirect) however caused (including through negligence) which you or anyone else incurs, without limitation and specifically damage to your software or hardware, arising from your use of or access to this Website or any linked third party website. You must  take your own precautions to ensure that whatever you select for your use from the Website is free of viruses or anything else (such as worms or trojan horses) that may interfere with or damage the operations of your computer systems.

The Migration Expo will have no responsibility or liability for  any advice given by any Exhibitor, Advertiser ,Visitor or Subscriber to any site visitor in relation to any products or services or any other activity presented or promoted by any participant on the website. The Migration Expo will also have no responsibility or liability in relation to any loss or damage (whether it be direct or indirect) however caused (including through negligence) which you or anyone else incurs,  arising from your use of or access to third party products, service and agreements directly or indirectly sourced through this website or any linked third party website.


Payments and Refunds:
Membership and the use of some facilities on the website are subject to subscription fees (any free access and promotional discounts are at the sole discretion of The Migration Expo). Subscription renewals are not automatic, and subscribers will receive renewal/expiry notices by email. For subscribers who do not renew within 6 months of expiry, any data relating to them on the website will be deleted after 6 (six) months.

Payments are accepted through secure third party gateways (such as Paypal) only.

Refunds will be issued under the following circumstances only;
a)  Fraudulent use of a payment card by a third party
b)  Website error resulting on overcharging, or charge for a service not requested
c)  Where an Advertisement has been booked and paid for, but the Advertisement has not been accepted/approved for display on the website

Advertising and ‘Exhibitor Stand’ content is subject to termination for breaching prohibited content and practices. No refunds will be given in these circumstances.

No Credit Card details are stored on the website at any time.

 
Payments to Exhibitors:
Exhibitors have mechanisms within their ‘stands’ to promote and sell products and services. Each stand has its own independent payment gateway link (Paypal). The Migration Expo has no connection or participation in those transactions, other than to provide a link to the Exhibitor’s own Paypal account. It is the user’s sole responsibility to ensure that any such payments are covered by the Exhibitor’s own terms and conditions, and their payments and refunds policy.


No Warranties:
The information on the Website is not comprehensive and is intended only to provide a summary of the subject matter covered. Except to the extent implied by applicable law that cannot be excluded or limited, The Migration Expo makes no warranty regarding the information on the Website. You must make your own assessment of it and rely on it wholly at your own risk.


Governing Law:
Your use of the Website and its terms of use are governed by the laws in force in New South Wales, Australia and you submit to the non-exclusive jurisdiction of the courts there.


User Generated Material:
The Website contains blogs and other user generated content which provide for comment or feedback by Users, real-time interaction between Users (including individuals referred to as guests and experts) and other electronic messaging and notice services ("User Generated Material").It is a condition of your inclusion of or use of any User Generated Material and your access to the Website that you do not do any of the following:
a)  restrict or inhibit any other user from using or enjoying any forum;
b)  post or transmit any material:
i) which is (or could reasonably be expected to be) unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent, including without limitation transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law;
ii) of any kind which is not your original work, or which violates or infringes (or could reasonably be expected to violate or infringe) upon the rights of any other person, including material which is protected by copyright, trademark or other intellectual property rights;
iii) which you know (or reasonably ought to know) to be false, misleading or deceptive
iv) of any kind which contains a virus or other harmful component;
v)  in any way exploit any material for commercial purposes or which contains any promotional material or advertising;
vi) which is an invasion of any privacy or publicity rights;
vii) which racially or religiously vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others based on gender, age, race, religion, sexual orientation, or any other physical or mental disability;
viii) harm minors in any way;
ix) impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
x) which promotes, describes, offers, or links to dangerous products or services, and/or counterfeit goods

The Migration Expo may from time to time monitor or review the contents of User Generated Material but The Migration Expo has the right (but not the obligation) in its sole discretion to pre-screen, refuse, or remove any User Generated Material that is available via the Website and is not responsible for any User Generated Material (including any information, comments and/or advice of any individual referred to as guest or expert whose statements on the Website are solely their own).

The Migration Expo retains the right and discretion to terminate your access to any User Generated Material if we believe you are abusing the service or breaching any of these terms or conditions.

You acknowledge that the comments or opinions contained in the User Generated Material are not the comments or opinions of The Migration Expo, and The Migration Expo accepts no liability in relation to material posted including its content or accuracy.

You agree to fully indemnify and hold harmless The Migration Expo and its related bodies corporate against liabilities, claims, loss (including consequential loss) or damage incurred:
a)  due to your reliance on any User Generated Material;
b)  as a result of material you post or as a result of any breach by you of these terms and conditions.

 

Privacy:
The Migration Expo will not release details of any website subscribers, visitors, advertisers, or any other enquiry details to any third party.

Access to any such details is restricted to appropriate subscribers only (for instance the Migrant List is only available to Registered Migration Agents who have subscribed (and been accepted) as Exhibitors).

The website will send emails as part of its standard functions – such as subscription renewals, advertising approvals, content updates – to subscribers, advertisers, and registered site visitors, but ongoing communications such as newsletters will not be sent without prior consent.

Visitors may agree to be contacted and/or emailed by Exhibitors. Any such agreements are outside any privacy limitations covered by this document, unless the communications themselves  or the pursuance thereof come within activities deemed to be prohibited content or practices. It is the responsibility of the site visitor to notify The Migration Expo of any such communications.

Migrants who place their details on the ‘Migrant List’ accept that they are making those details available to Registered Migration Agents (only) who are active/currently subscribed Exhibitors on the website.

Registered Migration Agents who access the ‘Migrant List’ do so for the sole purpose of providing immigration and associated services to migrants. Any abuse of this access, or subsequent activities which are deemed to come under the prohibited practices outlined above, will result in the disqualification and exclusion of the parties concerned.
